GENERAL TERMS OF SALES
PURPOSE:
Parkings City Services is a limited liability company with a registered capital of EUR 1,000, the registered office of which is located at 9, RUE NOTRE-DAME DE LORETTE 75009 Paris, registered in the Trade and Company Register of Paris under the number SIREN 510 777 519. Parkings City Services operates the Parkingsdeparis.com web based parking space reservation service accessible at the following address: http://www.parkingsdeparis.com
Parkings City Services is an independent operator. Its relationship with the car parks is based on agreements negotiated on a case-by-case basis with the car park operators.
The Parkingsdeparis.com reservation centre refers its clients to partner car parks who are contractually bound to guarantee a parking space for its clients even if the car park is officially "full" on the reserved date.
The Parkingsdeparis.com reservation centre is committed to finding a space for its clients and booking this, although this does not mean that the exact location of the space is determined in advance, except in the event of exceptions. This depends on the car parks. In certain establishments, the client must park in the space assigned to him. In others, he can park where he wishes.
The Parkingsdeparis.com reservation centre is committed to finding the best opportunities in terms of price, proximity, comfort and security based on its clients’ requirements.
ARTICLE 1 - BOOKING A « PARKING CITY PASS »
The "Parking City Pass" is the standard name used to refer to the parking packages created and introduced by the ParkingsdeParis.com reservation centre. Two types of passes are available for clients:
• * "Multiple entry/multiple exit" passes the details of which are described below.
• * "Low Cost" or "Event" or "Show" passes allowing you to enter and leave the car park just once, the terms of which are detailed below in the General Terms of Sale and in the Special Terms of Sale.
To make a reservation the customer should complete a form in which he provides various information including his identity, his contact information, his vehicle details, the type of pass he wishes to purchase in addition to his arrival and departure dates and times.
The characteristics of the car park, and in particular the maximum height of the vehicles able to enter the car park, the office opening times, the times during which passes can be issued, the entrance and exit times for vehicles in addition to the characteristics of the pass are supplied to the customer before the order is placed. The client formally agrees to study these details carefully. From that point on, neither Parkings City Services, nor the ParkingsdeParis.com reservation centre, nor the car park operator nor the car park owner may be considered liable for any direct or indirect losses suffered by the client, if the latter has made a reservation for a space in a car park which cannot accept his vehicle due to its height, length or width, if he arrives outside the opening hours of the car park or if he uses the pass in a manner which does not comply with the usage conditions for this particular pass.
ARTICLE 2 – PAYING FOR THE "PARKING CITY PASS"
The prices for all of the passes sold on the site are displayed in euros (inclusive of VAT).
Parkings City Services reserve the right to modify the prices shown on the ParkingsdeParis.com reservation centre website at any time, without notice, with it being clearly understood that such modifications will not apply to those reservations already accepted by the Parkingsdeparis.com reservation centre.
Parking costs, charges for any possible accompanying services accepted by the customer, and taxes are to be paid all at once, in euros, by credit card, via the double secure payment system provided by Paybox (www.paybox.fr) and by the bank BNP-PARIBAS on the ParkingsdeParis.com website. The parking space reservation is confirmed when payment is received. The confirmation of the order by the client implies unreserved acceptance of the present General Terms of Sale and the Special Terms of Sale.
ARTICLE 3- PAYMENT RECEIPT AND RESERVATION VOUCHER
Once the reservation is confirmed, the customer will receive two emails:
- - One includes the payment receipt enclosed as an attachment. This constitutes proof that the customer has paid for his order. The Voucher number is shown at the top of the receipt.
- - The other e-mail contains the Voucher, enclosed as an attachment in .PDF format. The customer must be sure to print out his Voucher in order to present it at the car park’s reception office. The car park attendant or car park owner is informed of the client’s arrival: Parkingsdeparis.com will have already sent him a copy of the Voucher.
In the message, the customer will also find a link enabling him to automatically download the access map for the car park in .pdf format.
ARTICLE 4 – ARRIVAL AT THE CARPARK
Two cases are possible :
- The car park has a barrier and an automatic time stamp terminal: The customer must take a receipt at the terminal and present it to the reception office with his time stamped receipt and his reservation voucher.
- The car park does not have a barrier: The customer should go directly to the car park’s reception with his voucher. At reception, according to his order type the client will receive either a "Multiple entry/Multiple exit" ticket or a "Single entry/Single exit" ticket.
ARTICLE 5 – EARLY ARRIVAL – LATE ARRIVAL
The fixed period covered by the parking pass begins at the client’s actual time of arrival noted at reception or printed on the time stamped ticket taken at the entrance to the car park. A fixed period of one day corresponds to a period of 24 hours beginning at the time the client arrives. The client can arrive earlier or later than the time shown on the Reservation Slip. Only the actual arrival time will be considered as the starting point for the parking pass.
ARTICLE 6 – EARLY DEPARTURE
If the customer decides, for whatever reason, to leave the car park before the end of the period covered by his parking pass, the customer will not be eligible for any refund of the unused hours. The Parking City Pass is not partially or integrally refundable.
ARTICLE 7 – LATE DEPARTURE
If the customer decides to leave his vehicle in the car park longer than planned and longer than stated on the voucher, the customer will be required to pay the extra costs to the parking attendant, these being billed based on the public prices displayed at the car park.
ARTICLE 8 – CANCELLATION AND NO-SHOW .
1/ Cancellation and no-show during the legal retraction period:
In conformity with article L. 121-20 of the Consumer Code, all clients have a period of seven clear days as from the date of their online purchase in which to exercise their right of retraction without needing to justify the grounds for this and with no penalty payable with the exception of return carriage costs (€6 inclusive of VAT).
When this seven (7) day period expires on a Saturday, a Sunday or a public holiday, the period is extended until the next working day.
In conformity with article L. 121-20-2 of the Consumer Code, the client may not use his right of retraction for the provision of services when the performance of these services has commenced with his agreement, before the end of the said period of seven (7) clear days.
During the legal retraction period, the client may receive a refund for his purchase as per the following conditions:
If the client cancels his reservation more than 72 hours before the scheduled arrival time he will receive a refund equivalent to 100% of the total value of his reservation, after the deduction of cancellation costs (€6 inclusive of VAT).
If the client cancels his reservation between 48 and 72 hours before the scheduled arrival time, he will receive a refund equivalent to 50% of the total value of his reservation.
If the client cancels his reservation between 24 and 48 hours before the scheduled arrival time, he will receive a refund equivalent to 25% of the total value of his reservation.
If the client cancels his reservation less than 24 hours before the scheduled arrival time, or if he fails to arrive at the car park, he may claim no refund and no compensation regardless of the circumstances.
In order to receive a refund, the client should submit his request by e-mail to the following address: contact@parkingsdeparis.com and state:
- The voucher number
- the complete number of the bankcard he used to make his purchase (16 figures)
- The expiry date (month and year) of the bankcard.
2/ Cancellation and no-show outside the legal retraction period:
Outside the legal retraction period, the client may receive a refund as per the following conditions:
If the client cancels his reservation more than 72 hours before the scheduled arrival time, he will receive a refund equivalent to 70% of the total value of his reservation.
If the client cancels his reservation between 48 and 72 hours before the scheduled arrival time, he will receive a refund equivalent to 40% of the total value of his reservation.
If the client cancels his reservation between 24 and 48 hours before the scheduled arrival time, he will receive a refund equivalent to 25% of the total value of his reservation.
If the client cancels his reservation less than 24 hours before the scheduled time and date of arrival, or if he fails to arrive at the car park, he may claim no refund and no compensation regardless of the circumstances.
In order to receive a refund, the client should submit his request by e-mail to the following address: contact@parkingsdeparis.com and state:
- The voucher number
- the complete number of the bankcard he used to make his purchase (16 figures)
- The expiry date (month and year) of the bankcard.
ARTICLE 9 - APPLICABLE LAW - LITIGATION
The ParkingsdeParis.com reservation centre acknowledges that in its dealings with Parkings City Services, E-mails exchanged with the ParkingsdeParis.com reservation centre and the electronic records generated on the ParkingsdeParis.com website are considered as valid and as having probative force.
Parkings City Services may not be considered liable or considered as having failed to observe the provisions of the present General Terms of Sale, concerning any delay or non-performance when the cause of the said delay or non-performance is the result of a case of force majeure as defined by the case law of the French courts.
Parkings City Services will accept no complaints, claims or other requests for refunds concerning the non-performance or poor-performance of the services supplied to the client when such problems are due either to the client himself, to a third party to the transaction, or to cases of force majeure.
Except in the event of legal provisions to the contrary, Parkings City Services may not be considered liable in the event of a fault being committed by a partner car park.
The provision of a parking space under no circumstances constitutes an entitlement to the guaranteed protection and surveillance of the vehicle but simply the price for parking the vehicle for the period of the pass acquired by the client. The client remains liable for any bodily harm, consequential losses and/or property damage caused by the transportation of the vehicle the parking space or within the car park. Parkings City Services declines all liability in the event of damage to the vehicle, accidents, or theft of all or part of the items or equipment contained in/on the vehicle.
The present contract is subject to French law. The language of the present contract is French. In the event of litigation, only the French courts will be considered as having legal competence.
ARTICLE 10- PERSONAL DATA
The information and data concerning the clients of the ParkingsdeParis.com reservation centre are necessary in order to process the orders. In conformity with the French data protection act of January 6, 1978, the clients of the ParkingsdeParis.com reservation centre have a right to access and rectify all personal data concerning them. To exercise this right, please write to contact@parkingsdeparis.com or Parkings City Services, 9, RUE NOTRE-DAME DE LORETTE 75009 Paris, stating your last name, first name and complete contact details.
SPECIAL CONDITIONS APPLICABLE TO THE SALE OF "SINGLE ENTRY/SINGLE EXIT" PARKING PASSES
PURPOSE:
Along with its selected partners, the ParkingsdeParis.com reservation centre has created "Single entry/Single exit" parking passes intended for clients who are leaving Paris for a few days or who do not wish to use their vehicle during their stay in Paris, or those visiting Paris to attend an event and who prefer to use public transport to get around after arriving in Paris.
DESCRIPTION:
The "Single entry/Single exit" passes concern the following:
- The POPB Event Packages (Rambuteau car park)
- The Stade de France Event Packages ( Rambuteau car park)
- The Paris Expo Porte de Versailles exhibition/event packages (the Porte d'Orléans and Charléty-Coubertin car parks)
- The Orly and Roissy CDG "Low Cost" parking packages (Rambuteau car park)
This list is not exhaustive: other packages may subsequently be added.
INSTRUCTIONS:
The "Single entry/Single exit" parking passes are governed by the General Terms of Sale with the exception of one important characteristic shared by each of these passes:
- The "Single entry/Single exit" ticket can only be used once. The moment your car leaves the car park, your reservation ends. The characteristics specific to each "Single entry/Single exit" pass and in particular the times at which these passes may be used, are described in the price lists for the car parks proposing these passes: Rambuteau, Porte d'Orléans and Charléty-Coubertin.
